Scope

These terms apply to the one-time Belgian Tender Brief pilot offered to business customers. A written proposal or order confirmation may add customer-specific details; if it conflicts with these terms, the expressly agreed written term takes priority.

1. Seller and eligibility

The legal seller is Intivoto, Kerkplein 13, 8540 Deerlijk, Belgium, enterprise and VAT number BE 0652.692.808. The pilot is offered only to customers acting for business or professional purposes, not to consumers.

2. Service

The €300 excluding VAT pilot consists of:

  • one agreed capability and no-go profile;
  • monitoring and email delivery of matched Belgian public IT notices for 14 consecutive calendar days;
  • up to five written qualification briefs for the strongest matches found during that period; and
  • a short closing review.

The service is a research and commercial qualification aid. It does not include bid writing, legal or procurement advice, eligibility certification, a guaranteed number of matches, or a guarantee of winning a contract.

3. Order and start

An order becomes binding when Intivoto confirms the scope and start date in writing and receives cleared payment. The customer must provide accurate profile information and a working delivery email. A requested start date is not reserved until confirmation.

4. Payment and delivery

The pilot price is €300 excluding VAT, charged once in euro. Applicable VAT is added to the payment request or invoice. Payment is due in full before delivery begins, using the secure payment methods shown on the payment page or the bank details on the invoice. No subscription or automatic renewal is created.

Delivery is electronic by email. The 14-day period starts on the date stated in the order confirmation. The customer is responsible for checking its mail filtering and promptly reporting a delivery problem.

5. Cancellation and refunds

The customer may cancel by email for a full refund before the agreed service start. After monitoring has started, the customer may stop future delivery, but amounts for work already performed are not refundable. If Intivoto cannot deliver a material part of the agreed service, Intivoto will either repeat that part or refund the reasonable undelivered portion. This does not limit rights that cannot legally be excluded.

6. Customer responsibility

The customer decides whether and how to act on a notice. Before bidding, it must review the official notice and complete documents, confirm eligibility and deadlines, and obtain its own professional advice where needed. Tender sources can change, be corrected or become unavailable.

7. Confidentiality and data

Each party will use non-public business information received from the other only for the pilot and protect it with reasonable care. The customer keeps ownership of its information. Intivoto keeps ownership of its methods, templates and pre-existing material. The customer may use delivered briefs internally for its bid decisions but may not resell or publish them as a competing feed.

8. Liability

To the extent permitted by law, Intivoto is not liable for an authority’s decision, a missed or changed notice, bid costs, loss of an opportunity, or indirect or consequential loss. Intivoto’s aggregate liability arising from the pilot is limited to the amount the customer paid for it, except where liability cannot legally be limited.

9. Ending the service

Either party may end the pilot immediately if the other materially breaches the agreement and does not remedy a remediable breach within a reasonable written period. Intivoto may suspend delivery where continued performance would be unlawful, unsafe or dependent on unavailable source access.

10. Law and contact

Belgian law governs the agreement. The competent Belgian courts have jurisdiction, unless mandatory law requires otherwise. Questions, complaints and cancellation requests must be sent to hello@hyperspicy.com. We normally acknowledge messages within two Belgian business days.
